Custom Song Terms

1. The Custom Song Service

Today’s Creative creates a custom song and related purchased deliverables from the information, story details, required items, prohibited items and creative direction the customer provides. The customer controls the facts and requested direction; Today’s Creative retains reasonable creative discretion over lyric structure, phrasing, arrangement, instrumentation, pacing, production, vocal interpretation, transitions, mix decisions, song length and other artistic choices. A reference artist, song or genre is used only for broad direction and does not promise imitation of another artist, recording or protected work.

2. Request, Acceptance & Project Formation

Submitting a questionnaire creates a request for review only. It does not obligate Today’s Creative to accept the project and does not create a paid commission. Today’s Creative may approve, request clarification or decline a request. A project is accepted only after Today’s Creative approves the scope and price, the customer confirms the approved project and required policies, and payment is successfully completed. A payment approval normally remains available for 7 calendar days unless Today’s Creative extends, replaces or withdraws it.

3. Price, Credits & Payment

The customer-facing approved project screen controls the price for that project. Courtesy, promotional or beta credits reduce the amount due for that project only and do not change Today’s Creative’s standard catalog value. Applicable taxes, if any, and checkout processing are handled through the approved payment provider. Payment is not considered complete until Today’s Creative receives a successful payment record that matches the approved project amount and currency.

4. Cancellations & Refunds

After payment, the customer normally has 48 hours to cancel for a full refund of the project payment, subject to any nonwaivable rights required by law. The customer may optionally authorize Today’s Creative to begin substantive creative work before that period ends. Merely giving that authorization does not change the refund amount. If Today’s Creative actually begins substantive Writing under the authorization before the normal deadline, the remaining full-refund cancellation period ends when Writing begins and the standard stage-based refund policy applies immediately: while Writing has begun but Production has not begun, 50% of the main-song price is treated as earned for work performed; once Production begins, the main-song price is non-refundable under the standard cancellation policy. If the customer does not authorize an early start, or Today’s Creative does not begin work early, the normal 48-hour full-refund period remains in place. If that period expires and substantive Writing still has not started, the main-song price remains fully refundable until Writing begins. Separately priced add-ons and paid change requests are evaluated according to the work actually started or completed on those items. These rules do not limit any nonwaivable right or remedy required by applicable law. Approved refunds are returned through the available payment method; provider processing time is outside Today’s Creative’s control.

5. Customer Information & Responsibilities

The customer is responsible for providing accurate names, pronunciations, relationships, dates, factual details, requested exclusions and other information that materially affects the song. Requested event or delivery dates are considered but are guaranteed only when Today’s Creative expressly confirms a delivery date in the project record. The customer must promptly review requests for clarification and approvals. Knowingly false, misleading, unlawful or rights-infringing information may result in a hold, decline or closure.

6. Creative Process, Reviews & Changes

The included Story Accuracy Review is designed to correct factual or story details Today’s Creative misunderstood, including names, pronunciation, relationships, dates, locations, required details, prohibited details or material story meaning. It is not an unlimited rewrite, a guarantee of a particular subjective reaction or a free change to an entirely new creative direction. Personal Custom Songs receive the included final Story Accuracy Review after production. Legacy Songs also require affirmative pre-production lyric approval. Silence does not count as approval. Work requested outside the included review may be offered as a separately priced change request before additional work begins.

7. Production Technology

Today’s Creative combines human storytelling, lyric development, creative direction, editing, selection, quality control and modern music-production technology. Generative or AI-assisted tools may be used for lyrics, composition, instrumentation, vocals, arrangement, artwork, video or related project elements. Every delivered Custom Song is directed, reviewed and selected by Today’s Creative. Today’s Creative will use production providers under account or license terms reasonably intended to permit the purchased use, but third-party platform terms and technology may change over time.

8. Customer Materials, References & Third-Party Rights

The customer must own, create or have permission to provide any lyrics, photographs, recordings, written material or other content submitted for the project. Today’s Creative will not intentionally copy protected lyrics, melodies, recordings, recognizable hooks or another real artist’s identity. References should be provided for broad emotional, structural or genre direction, not for duplication. Unauthorized voice cloning or deceptive impersonation is not offered. Today’s Creative may pause or decline work if ownership, permission or lawful use is unclear. The customer remains responsible for claims caused by material the customer knowingly supplied without the necessary rights or permission.

9. Delivered Song, Ownership & Personal-Use License

The customer retains whatever rights the customer already owns in original material the customer supplied. Today’s Creative retains its rights in its original creative contributions, production materials, branding, methods and working files, to the extent those rights exist and are legally protectable. After full payment and final delivery, the purchaser and intended recipient receive a permanent, worldwide, non-exclusive personal-use license to the delivered final project to the extent Today’s Creative owns or controls the rights necessary to grant that license. This is not a work-for-hire agreement, copyright assignment, master-rights transfer, publishing-rights transfer or exclusive commercial license. Internal drafts, unused versions, prompts, production notes, unused generations, stems and methods are not included unless expressly listed in the approved project.

10. Optional Public Streaming Release

If purchased, Public Streaming Release is a separate managed distribution service. Distribution occurs only after final approval and separate Streaming Authorization. Today’s Creative manages the distributor account and release administration. The add-on does not give the customer independent distribution rights, ownership of Today’s Creative’s distributor account or royalty participation unless a separate written agreement expressly says otherwise. Customer-authored copyrightable material may require additional documentation before public distribution.

11. Privacy & Project Information

Projects are private by default. Public Streaming and promotional permission are separate choices. Review materials and project files use protected access. Today’s Creative does not automatically receive promotional rights to the customer’s private questionnaire, story, identity, photograph, testimonial or project materials. Personal information is handled under the current Privacy Policy.

12. Project Delays, Customer Inactivity & Scheduling

When Today’s Creative requires customer action, the normal response window is 5 calendar days and the project clock may pause while the project is waiting on the customer. Extended inactivity may lead to closure after the documented reminder process. A closed project may require a new review, revised timing or a paid change request before work resumes.

Legacy Story Interviews are normally 30 minutes. One included reschedule may be available with at least 24 hours’ notice. A late-reschedule fee of $25 may apply with less notice, and a no-show fee of $35 may apply after the 10-minute grace period. Today’s Creative may waive a fee when appropriate. Meeting-provider outages may require a reasonable substitute method or reschedule.

13. Delivery, Portal Access & Customer Backups

Final deliverables are provided through the protected customer portal or another secure method identified by Today’s Creative. Guaranteed download access is maintained for at least 60 days after final delivery unless the project states a longer period. The personal-use license does not expire merely because hosted download access later ends. The customer is responsible for downloading and keeping backup copies of final deliverables during the guaranteed-access period.

14. Prohibited / Unsupported Requests

Today’s Creative may decline, pause or stop work involving unauthorized copyrighted material, unauthorized voice cloning, deceptive impersonation, malicious harassment, credible threats, encouragement of violence, privacy-invasive requests, serious reckless allegations, illegal activity, exploitation, intentionally false requests or material inconsistent with Today’s Creative’s Christian mission and business standards. If a project is stopped after payment, any refund or credit is determined under the cancellation rules, work already performed and applicable law.

15. Service Limitations & Third-Party Services

Today’s Creative does not guarantee a particular emotional reaction, exact song runtime, approval by a recipient or audience, availability of any specific third-party provider, streaming-platform acceptance, playlist placement, streams, followers, radio play, viral performance, charts, engagement, income or royalties. Reasonable provider substitutions, outages, distribution delays and events outside Today’s Creative’s reasonable control may affect timing. If a material service failure prevents Today’s Creative from delivering the purchased project, Today’s Creative will work in good faith toward replacement performance, rescheduling, credit or refund as appropriate.

16. Liability Limits

To the fullest extent permitted by applicable law, Today’s Creative is not liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from the Custom Song service, third-party platforms or the customer’s use of a delivered project. To the fullest extent permitted by law, Today’s Creative’s aggregate monetary liability arising from a particular project will not exceed the amount actually paid to Today’s Creative for that project. These limitations do not apply where prohibited by law and do not limit liability that cannot legally be waived.

17. Disputes & Governing Law

Before filing a formal claim, the parties agree to make a good-faith effort to resolve the issue directly for at least 14 days after written notice describing the problem and requested resolution. These Terms are governed by Illinois law to the extent permitted by applicable law, without waiving any nonwaivable consumer right or remedy. Any court proceeding that may lawfully be required to occur in a particular location will follow applicable law; otherwise the parties consent to an appropriate state or federal court in Illinois.

18. Electronic Agreement, Records & Contact

By using the service, checking required agreement boxes and submitting electronic confirmations, the customer agrees to conduct the Custom Song transaction electronically and to receive project records and notices electronically. The service uses account authentication, confirmation buttons, timestamps and versioned policy records to document material decisions. Customer project decisions and material changes should be made through the secure portal or another written record supplied by Today’s Creative. The portal is the primary project-response channel. 19. Entire Agreement, Changes & Severability

These Terms, the customer’s approved project scope and price, the Privacy Policy, any applicable add-on authorization, and any later written change request accepted by both sides form the agreement for the project. If a project-specific written term conflicts with these general Terms, the project-specific term controls only for that issue. Published policy changes apply prospectively unless the customer affirmatively accepts an updated version for an existing project. If a provision is found unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision once does not waive future enforcement.
